1. Acceptance of Terms

By accessing and using ScanMySites ("the Service"), operated by General Business Consultants and Information, LLC (GBCAIN), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ScanMySites provides website analytics, SEO auditing, security scanning, and uptime monitoring services. The Service includes both free and paid subscription plans with varying feature levels.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account
4. Subscription Plans and Payments

Paid plans are billed on a recurring basis (monthly or annually) unless cancelled. By subscribing to a paid plan, you authorize us to charge your payment method at the beginning of each billing cycle.

  • Prices are displayed in USD and are subject to applicable taxes
  • You may upgrade or downgrade your plan at any time
  • Cancellations take effect at the end of the current billing period
  • No partial refunds are provided for unused portions of a billing period
5. Free Trial

We may offer a free trial or free demo scan. Free trials are limited to one per user and are subject to the limitations described at the time of registration. After the trial period, you will need to subscribe to a paid plan to continue using premium features.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Scan or audit websites you do not own or have authorization to scan
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to access the Service beyond the provided API
7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described therein. You retain ownership of any data you submit to the Service.

8. Intellectual Property

The Service, including its software, design, logos, and content, is the property of GBCAIN and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. GBCAIN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or modifications to the Service with reasonable notice when possible.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us.

12. Refunds

Refunds may be issued on a case-by-case basis within 14 days of purchase. To request a refund, please contact us through our Contact page.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions.
